I noticed about 20 mintues from the end the is a huge red scratch on Al Pacino's face.

now I'm curious, What do they use to make the DVD with? Is it just a print that they scan or do they use the original negatives or what?

it all depends on what elements they can find to produce the finished product. in some cases there may be damage to the original negatives that were beyound their ability to use and they had to resort to other elements like release prints. In the case for this production I am not sure what issues there may have been.

Prints have too much contrast to make the best video transfers. Generally, they make a low contrast interpositive for the transfer. As Darryl said, a lot depends on what survives - if it's a title for which only positive print material exists, they have to work with that.

Compared the original 1998 dvd release of Scarface, the picture quality on this 20th Anniversary edition is pretty damn good.

The sound, especially the DTS track is not very good. Hardly no LFE whatsoever.

Usually, the best video transfers are made from an interpositive or duplicate negative:

Although Kodak does make a special low contrast print film intended specifically for telecine transfer:
